The federal appeals court has upheld a prohibition on deploying state troops in Portland, Oregon, after a recent legal decision.

Judicial Panel Agrees to Reconsider Case

The ninth circuit court of appeals ruled on this week that it would reexamine the case concerning the executive power with an larger group of eleven justices. The judicial body also overturned a earlier ruling from a three-judge panel that had sided with the administration.

Legal Saga Over Troop Deployment

This order represents the most recent development in a long-running court case over whether the administration has the legal right and justification to deploy state military units in Portland. Approximately two hundred troops have been in limbo since late September when the deployment effort was initiated in response to ongoing demonstrations.

Conflicting Arguments

The administration has claimed that government employees at the immigration center in south Portland were facing threats, while local authorities assert that local officers have command of the circumstances.

In defiance of descriptions of Portland as “war ravaged”, locals have been posting footage of lush hiking trails and a thriving food scene, and planning activities such as an Emergency Naked Bike Ride against the increased military presence.

Recent Legal Actions

The appeals court decision came after a US district judge in the city issued two temporary restraining orders this period – one preventing the federal control of the Oregon national guard, and another stopping the deployment of any national guard troops in the state, after attempts to circumvent the first order by mobilizing out-of-state forces.

On Monday, the ninth circuit panel had temporarily suspended the initial decision – allowing command of state troops – but the subsequent injunction stayed effective, preventing the actual deployment of the forces.

Full Panel Consideration

The Tuesday decision means the matter will be heard by the full court – with all decisions under review simultaneously – by a panel of eleven justices.

“This ruling shows that facts are important and that the judicial system are striving to hold this administration accountable. The constitution restricts the president’s power, and Oregon’s communities cannot be treated as a testing site for unchecked federal authority,” stated the state attorney general in a official comment.

“The court is sending a definite signal: the executive leader cannot dispatch the armed forces into American urban areas unnecessarily. We will continue defending state legislation, values, and autonomy as this legal proceeding moves forward and our legal battle continues in the courts.”
